ICSPR Organizes an Awareness Workshop on Procedures for Establishing the Legal Status of Missing Persons and Their Legal and Sharia Implications

The International Commission to Support Palestinian People’s Rights (ICSPR) organized a specialized legal awareness workshop entitled “Procedures for Establishing the Legal Status of Missing Persons and the Resulting Legal and Sharia Implications.” The workshop was held at Al-Yarmouk Stadium and brought together between 20 and 25 women and interested participants as part of ICSPR’s ongoing efforts to enhance legal awareness and empower women to understand their rights amid the exceptional circumstances facing the Gaza Strip.

The workshop was facilitated by legal attorney Nermin Al-Louh, who presented the legal and Sharia framework governing the procedures for establishing the legal status of missing persons. She highlighted the mechanisms followed by the Sharia courts in handling such cases, responding to the growing need for legal awareness in light of the increasing number of missing persons resulting from the current situation.

The workshop addressed several key topics, including the legal and Islamic definition of a missing person, the distinction between a missing person and an absent person, and the legal classification of each case. It also explained the procedures and required documentation for filing missing-person cases before the Sharia courts, helping affected families understand and navigate the legal process.

In addition, the session discussed the legal and religious consequences of establishing the status of a missing person, particularly with regard to guardianship, inheritance, alimony, and the legal and Sharia status of spouses and children. Emphasis was placed on the importance of safeguarding the legal and financial rights of affected families and ensuring their access to justice.

The workshop witnessed active participation from attendees, who raised numerous questions regarding real-life cases and the legal challenges faced by families of missing persons. Discussions focused on available legal solutions and practical procedures for addressing these complex issues.

ICSPR affirmed that organizing this workshop is part of its ongoing legal awareness and capacity-building programs aimed at strengthening legal literacy among vulnerable groups, empowering women to understand and claim their rights, and promoting access to justice and the rule of law within Palestinian society.
