ICSPR Executions in Gaza Strip violates the constitutional, legal and judicial guarantees

International Commission to Support Palestinian Rights (I.C.S.P.R) followed with great concern on Thursday 6 April 2017, that Gaza Ministry of Interior executed three Palestinians (55-year-old O.M., 42-year-old W.A., and 32-year-old A. Sh) charged with collaborating with Israel.

The Interior Ministry in Gaza Strip, issued a press release on its website, confirmed that the implementation of the executions was made after exhausted all methods of appeal therefore it became final, conclusive and enforceable after given the full right to defend themselves.

International Commission to Support Palestinian Rights (I.C.S.P.R) consider that executions is not an appropriate remedy to reduce the crime of collaboration with the enemy, or other crimes, but to address the reasons of this crime, especially of the political, economic and social terms with attention, including the development of national policies and legal and judicial frameworks to encourage respect for the rule of law, the right to life and human dignity.

International Commission to Support Palestinian Rights (I.C.S.P.R) reaffirms its call to cancel this cruel punishment, which violates the right to life and replace it with another penalty agree with principle of criminal justice, it condemns that official authorities in Gaza Strip continued on death sentences without respect of law prohibiting execution without authentication of the president, stressing that it does not diminish the seriousness and does not mean impunity, it consider the seriousness to repeat the executions, and especially in light of the continuing political, legal and judicial division, it affirms the following:

ICSPR demand competent authorities in Gaza Strip to stop executions, and abide by the legal resolutions to provides fair trial.
ICSPR encourages Palestinian officials to join Second Optional Protocol to the International Covenant on Civil and Political Rights, aiming at the abolition of the death penalty.
ICSPR call to make a modern Palestinian Penal Code come along, consistent with international standards, ensuring that replaced the death penalty with deprivation of liberty, which would make a genuine balance between criminality and impunity and ensuring general deterrence.
