ICSPR Condemns Presidential Decree-Law on Dissolution of the Arab Development Society
The International Commission to Support Palestinian Rights (ICSPR) has followed with deep concern and dissatisfaction the issuance of a presidential decree-law in 2025, published on January 8, 2025, which mandates the dissolution of the General Assembly and Board of Directors of the “Arab Development Society” and the appointment of a temporary committee to carry out the tasks of the Board of Directors.
This decision represents a serious infringement on the principle of the rule of law and the independence of civil society organizations, which constitute a cornerstone for promoting democracy and respecting human rights. Furthermore, this measure is a clear violation of the Palestinian Basic Law, particularly regarding the guarantee of freedom of association and the independence of its work. It also echoes previous similar experiences, including decisions to dissolve or undermine the work of numerous organizations in the past, which have contributed to shrinking public freedoms and negatively impacted the role of these institutions in serving Palestinian society.
ICSPR emphasizes that this decree contradicts existing laws, including the Palestinian Basic Law and Law No. 1 of 2000 on Charitable Associations and Civil Society Organizations, which ensure the independence of associations and limit the executive authorities’ interference in their affairs. The decree lacks sufficient objective and legal justifications. Moreover, it contradicts the State of Palestine’s commitments under international human rights conventions, particularly the International Covenant on Civil and Political Rights, which guarantees freedom of association and protection from arbitrary interference in its operations. Therefore, ICSPR asserts and demands the following:
- ICSPR: Affirms that the decision poses a threat to civil society and undermines opportunities to build a democratic Palestinian society based on the rule of law and respect for human rights.
- ICSPR: Calls on the Palestinian President to revoke the decree-law to ensure respect for the Palestinian Basic Law and protect the independence of civil society organizations.
- ICSPR: Urges Palestinian official bodies to refrain from interfering in the affairs of civil society organizations without clear and objective legal justifications.
- ICSPR: Encourages the relevant authorities to strengthen adherence to the principles of the rule of law, ensuring the continuity and independence of civil society operations.
