ICSPR welcomes the International Court of Justice’s ruling on Gaza and condemns the Israeli Knesset’s approval of the draft law to annex the West Bank
The International Commission to Support Palestinian Rights (ICSPR) welcomes the ruling issued by the International Court of Justice (ICJ), which unanimously affirmed the responsibility of the Israeli occupation authorities for the humanitarian catastrophe in the Gaza Strip. The Court obligated Israel to ensure the fulfillment of the basic needs of the civilian population, allow the unrestricted entry of humanitarian aid, and enable the United Nations Relief and Works Agency for Palestine Refugees (UNRWA) to perform its duties with full freedom.
ICSPR praised the Court’s emphasis on UNRWA’s neutrality and the absence of any evidence of bias or politicization of its work, as well as its condemnation of the use of starvation as a weapon of war, considering it a flagrant violation of international humanitarian law.
ICSPR views the ruling as a victory for human values and international law, and as a clear response to the Israeli incitement campaign against UN institutions, foremost among them UNRWA.
ICSPR affirms that the implementation of this ruling is a legal obligation on Israel, not a political choice. It calls on the United Nations and the High Contracting Parties to the Geneva Conventions to take urgent action to compel Israel to comply with the ruling and lift the blockade and restrictions imposed on the entry of humanitarian, medical, fuel, and essential supplies into the Gaza Strip — particularly in light of UNRWA’s confirmation that 6,000 relief trucks remain blocked, enough to meet the needs of Gaza’s population for six months.
ICSPR strongly condemns the Israeli Knesset’s preliminary approval of the draft law to “impose sovereignty over the West Bank,” considering this step a war crime and a blatant violation of international humanitarian law and international legitimacy, including UN Security Council Resolutions 242, 338, and 2334, as well as other UN General Assembly resolutions and ICJ opinions. ICSPR stresses that this measure entrenches the system of apartheid and colonial annexation, threatens to ignite the situation, and undermines any prospects for the establishment of a Palestinian state.
ICSPR also values the Arab and international positions that condemned this dangerous move aimed at legitimizing the de facto policies imposed by the Israeli occupation government. It calls for transforming these condemnations into practical steps, including the imposition of diplomatic, economic, and cultural boycotts and sanctions, and the prosecution of Israeli leaders before the International Criminal Court (ICC) through the principle of universal jurisdiction.
ICSPR affirms that the ICJ’s ruling places the international community before a true test: to ensure Israel’s compliance with international law, end the blockade and obstruction of humanitarian aid to Gaza, guarantee the freedom of work for international organizations—foremost among them UNRWA—and exert pressure to ensure respect for and implementation of international judicial and UN resolutions related to the Palestinian cause. This would guarantee the end of the Israeli occupation, the dismantling of the colonial apartheid regime, and the Palestinian people’s right to self-determination, the establishment of their independent state with Jerusalem as its capital, and the return of refugees.
